# La Cartita Categorized News Dataset — License Agreement

**Effective Date:** Date of payment (Enterprise) or written approval (Individual / Non-profit).
**Licensor:** finit.dev — operator of lacartita.com. Contact: lezama@finit.dev
**Dataset:** The CSV export titled `lacartita_dataset.csv` (and any subsequent refresh of the same file), containing post id, date, title, content, excerpt, slug, and categories drawn from lacartita.com.

The Dataset and its underlying journalism are protected by copyright and database rights of finit.dev. By accessing, downloading, or using the Dataset you agree to the terms below.

## 1. License Tiers

### 1.1 Enterprise License — USD 10,000, one-time payment

Granted upon successful payment via the Licensor's Stripe checkout. **A single payment of USD 10,000 conveys access to the complete Dataset** — every row, every column, every category, with no per-record fee, no per-seat fee, and no recurring charge. The Licensor grants the paying entity a **perpetual, worldwide, non-exclusive, non-transferable, non-sublicensable** right to:

- download the **full corpus** of `lacartita_dataset.csv` (currently several thousand articles and growing — refer to the public tally on the license page for the live row count at time of purchase);
- receive **all future refreshes** of the same file at no additional cost, for as long as the Licensor publishes them;
- store the Dataset on the Licensee's internal systems and replicate it to the Licensee's employees and contractors;
- use the Dataset to train, fine-tune, evaluate, or benchmark machine-learning models for the Licensee's own products and research;
- derive aggregate statistics, embeddings, classifiers, and other analytical outputs;
- ship products that incorporate insights or model weights derived from the Dataset, **provided** that the raw rows of the Dataset are not redistributed to third parties.

The license covers a single legal entity. Subsidiaries and affiliates are not automatically covered — contact the Licensor for multi-entity terms.

**What is NOT bundled in the $10,000 fee:** redistribution rights to third parties, exclusivity, custom data extractions, bespoke schemas, white-glove integration support, or coverage of multiple legal entities. Each is available separately — email the Licensor.

### 1.2 Individual & Non-profit License — Free, by request

Individuals using the Dataset for personal, academic, or journalistic purposes, and registered non-profit organizations using it for non-commercial work, may obtain a free license by emailing **lezama@finit.dev** with:

1. a brief description of the intended use;
2. the names of the people or organization that will hold the data;
3. an estimated duration.

Approval is at the Licensor's discretion and is normally granted within five business days. The free tier carries the same Attribution and Restriction obligations as the Enterprise tier.

## 2. Attribution (mandatory for all tiers)

Licensees must credit La Cartita / finit.dev wherever the Dataset, or work derived from it, is published or shipped:

- **Software & repositories:** include a `README.md` (or equivalent) with the attribution block found in `ATTRIBUTION.md`.
- **Written publications, papers, and articles:** include the citation provided in `ATTRIBUTION.md` in the references section. The dataset name, source URL (`https://lacartita.com`), and access year must be stated.
- **Customer-facing products:** if the Dataset materially contributes to a feature, the product's "About / Credits" surface must list La Cartita as a data source.

Failure to attribute is a material breach and terminates the license automatically.

## 3. Restrictions

You may **not**, without prior written consent from the Licensor:

1. resell, sublicense, lease, or otherwise redistribute the raw Dataset or substantial portions of it;
2. publish the Dataset on a public mirror, torrent, or open data portal;
3. use the Dataset to construct a substitute service that competes with lacartita.com as a news outlet;
4. remove or obscure copyright or attribution notices.

Storing the Dataset behind authentication for the Licensee's own employees and contractors is permitted under the Enterprise tier.

## 4. Data Refreshes & Updates

The Licensor refreshes `lacartita_dataset.csv` periodically. Enterprise licensees are entitled to fetch the most recent version for the duration of their license. The Licensor does not warrant any specific refresh cadence.

## 5. Privacy & Source Material

The Dataset is composed of articles published openly on lacartita.com. The Licensee is responsible for its own compliance obligations (GDPR, CCPA, etc.) when processing the data — including any obligations triggered by training models on it.

## 6. Warranty Disclaimer

THE DATASET IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

## 7. Limitation of Liability

To the maximum extent permitted by law, the Licensor's aggregate liability under this Agreement is limited to the fees actually paid by the Licensee in the twelve months preceding the claim. The Licensor is not liable for indirect, incidental, special, consequential, or punitive damages.

## 8. Termination

This Agreement terminates automatically on material breach (including failure to attribute or any of the Restrictions above). On termination the Licensee must cease use of the Dataset and destroy all copies, except for derived model weights and aggregate statistics already shipped to end users in good faith.

## 9. Governing Law

This Agreement is governed by the laws applicable at the principal place of business of finit.dev. Disputes will be resolved in the competent courts of that jurisdiction.

## 10. Entire Agreement

This document is the entire agreement between the parties regarding the Dataset and supersedes any prior understanding. Amendments require a writing signed by both parties.
